Terms Of Use

Effective date: July 7, 2026. These terms govern use of Sotemi, a private travel sharing app operated by Luis Andrés Medina Calderón.

Eligibility And Minimum Age

Sotemi may only be used by people who are at least 13 years old. Users must provide an accurate date of birth when creating or completing an account. Accounts found to belong to users under 13 will be removed, together with their associated personal data, as described in the Privacy Policy.

Users under 18 may use Sotemi only with the permission of a parent or legal guardian where applicable law requires it.

Sotemi is currently offered in Mexico, the United States and selected Latin American countries; availability in other regions may be added over time.

Accounts

Users are responsible for their account activity and should keep login credentials secure. Users must provide accurate information when required for account, support, safety or legal purposes.

Private Trips

Trips are private spaces for invited members. Users may not attempt to access trips, content or data where they are not an approved member.

User Content

Users are responsible for content they upload, including photos, videos, audio, captions, comments, tags and profile information. Users must have the rights and permissions needed to upload and share that content.

By uploading content, users grant Sotemi the limited permission needed to host, store, display, transmit and operate that content inside the app. Users keep ownership of their content.

Content shared inside a trip can be viewed, saved and downloaded, in full quality, by the approved members of that same trip, using features Sotemi provides for that purpose. Members may keep those copies on their own devices. Users should only share content in a trip that they are comfortable letting the other members of that trip keep.

Shared Content And Member Conduct

Sotemi is a space for sharing travel memories with the members of a private trip. By joining a trip and uploading content to it, a user understands and agrees that the photos, videos and other content they add to that trip are visible to, and can be saved or downloaded by, the other approved members of that trip. This is a core part of how a shared trip works.

Users may use content shared by other members only for personal purposes connected to the trip. Users must not sell, publish, redistribute or share another member's content outside the trip without that member's permission. Misusing another member's content may violate these terms, the rights of that member, and applicable law, and is the sole responsibility of the user who does so.

Sotemi provides the tools to share within a trip but does not control, and is not responsible for, what members do with content once it has been shared with them, including copies they save or download to their own devices or share outside the app. Users who do not want other members to be able to keep a copy of a photo or video should not share it in a trip.

Prohibited Content And Conduct

  • Illegal, hateful, harassing, sexually explicit, exploitative or violent content.
  • Bullying, threats, impersonation, doxxing or abuse.
  • Content that violates privacy, copyright, trademark or other rights.
  • Attempts to bypass security, RLS, invite controls or account restrictions.
  • Spam, scams, commercial scraping or unauthorized automation.
  • Sharing invite links or private content outside the intended group without permission.

Moderation

Sotemi may remove content, restrict accounts, review reports, block access or take other safety actions when content or behavior violates these terms, community rules or applicable law. Sotemi operates a zero-tolerance approach to objectionable content and abusive users.

Copyright Complaints And Takedown (DMCA)

Sotemi respects intellectual property rights and responds to copyright complaints, including notices under the U.S. Digital Millennium Copyright Act (DMCA). To report content that infringes a copyright, send a notice to the designated agent: Luis Andrés Medina Calderón, email mel1am@hotmail.com.

A complete notice must include:

  • Identification of the copyrighted work claimed to be infringed.
  • Identification of the allegedly infringing material and information reasonably sufficient to locate it (for content inside a private trip, include the trip, post or profile details available to you).
  • The complainant's name, address, email and telephone number.
  • A statement of good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
  • A statement, under penalty of perjury, that the notice is accurate and that the complainant is the owner or authorized to act on the owner's behalf.
  • A physical or electronic signature of the complainant.

Takedown Process And Repeat Infringers

Upon receiving a valid notice, Sotemi will remove or disable access to the identified material and notify the user who posted it. A user who believes material was removed by mistake or misidentification may send a counter-notice with the elements required by the DMCA to the same address; if a valid counter-notice is received, the material may be restored as the law allows.

Sotemi terminates, in appropriate circumstances, the accounts of users who are repeat infringers.

Disclaimers

Sotemi is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by applicable law.

Sotemi does not guarantee that the service will be uninterrupted, error-free or permanently available, or that content will never be lost. Users should keep their own copies of important photos and videos. During beta and early releases, features, availability and data handling may change.

Limitation Of Liability

To the fullest extent permitted by applicable law, Luis Andrés Medina Calderón and Sotemi will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, profits, goodwill or content, arising from or related to the use of (or inability to use) Sotemi. To the same extent, the total aggregate liability for all claims related to the service is limited to the greater of one hundred U.S. dollars (US$100) or the amounts the user paid to Sotemi in the twelve months before the claim.

To the fullest extent permitted by applicable law, Sotemi is not responsible for the conduct of other users, including how the members of a trip use, save, download, keep or share content that another user has made available to them inside that trip. Interactions between users, and any use of shared content outside the app, are the responsibility of the users involved.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of the sections above may not apply. Nothing in these terms excludes or limits liability that cannot be excluded under applicable law, including mandatory consumer protection rights in the user's country of residence or liability arising from fraud, gross negligence or willful misconduct.

Account Deletion

Users can delete their account at any time from inside the app, in Settings. Deletion is described in the Privacy Policy.

Governing Law

These terms are governed by the laws of the United Mexican States, with exclusive venue in the courts of the State of Mexico (Estado de México).

Sotemi is provided on an as-is and as-available basis. To the extent permitted by law, Sotemi is not liable for indirect or incidental damages arising from use of the app. Availability, features and data handling may change as the product evolves.
